New York Divorce Mediation Intervention

By Janelle Burnett

New York divorce mediation is often needed when couples can no longer see eye to eye in their proceedings. Because there are many areas of a marital split that need to be considered, many couples look for a third party arbitrator to handle their proceedings. Even if there is not a lot of issues that need resolution, or the couple has only been married for a few years, many people feel it is best to have someone process through all the separation issues to ensure everything is fair.

There are many couples who decide to call it quits after several years of marriage. Other couples realize they have gone into their marriage prematurely or are not ready to settle down. Still, other couples cannot seem to get along and realize they will be happier apart than together.

Property and living logistics are the other important components of dissolution of marriage. Regardless of how many years a couple has been together, there is always a lot to consider. If you did not own a home, that will minimize a lot of discussions, however if you do own property, there is a lot to consider.

When a couple has moved far beyond the ability to communicate, they need to have an arbitrator intervene to handle their proceeding. Many couples will find that they are arguing over things that are worthless and have no value, however, the animosity between the couple impairs their ability to communicate. Sitting down with a third party to make the process less stressful is important for everyone involved.

When couples have been married for a number of years, there are many things to discuss. There are situations where a wife never worked in order to maintain a home and raise children. She never had an opportunity to earn a living and was put in a situation to rely on her spouse to care for her needs. In cases like these, alimony is often required. If the wife is forced to go work after a breakup, her earning potential will be limited, and, therefore, her husband will have to help finance her living.

Splitting up retirements and determining what is fair for each spouse is never easy. People do not want to surrender their asset so easily, however, in many cases, this cannot be disputed. Retirement plans and pensions are among the many assets that are on the table for discussion when couples split.

If the couple can work things out on their own without an arbitrator, it is beneficial. However, most couples cannot cooperate and find the discussions too exhausting and stressful. A third party will make sure the proceedings are as stress free as possible and that resolution is quick.

New York divorce mediation is needed when couples can no longer work their separation issues out in an amicable manner. When there is an intercessory party helping to sort out the hard issues that result out of the dissolution of marriage, there is much less strain and suffering. The process may not be easy or painless; however, allowing someone to intervene would get the parties one step closer to resolution.
